Terms of Service

As a nonprofit choosing to participate and collaborate as a benefitting partner, 35 Hours of Giving requires that you enter into this Memorandum of Understanding which sets forth the services and duties provided by the 35 Hours of Giving, as well as the roles and responsibilities of all participants.

  1. I confirm that my organization is a 501(c)3 and agree to provide our EIN number, contact info, and a representative’s information for verification.
  2. I confirm that our organization is legally authorized to fundraise in the state of Michigan and is registered to do so with the Michigan Attorney General’s office in accordance with the Michigan Organizations and Solicitations Act.
  3. I confirm that our organization is located in, serving, and/or conducting organizational activities in Ingham, Clinton, or Eaton County, Michigan.
  4. I understand that my organization is encouraged to focus the majority of its overall marketing efforts in the days immediately leading up to 35 Hours of Giving to the campaign to create a sense of excitement among donors, volunteers, media partners, and fellow nonprofits.
  5. I understand that if asked to participate in any media interviews (e.g., newspapers, online, television, radio) that I speak on behalf of all nonprofits participating in 35 Hours of Giving rather than focusing solely on the organization I represent.
  6. I confirm that my organization has a website or Facebook page and that we will add the 35 Hours of Giving link to one or both.
  7. I understand that my organization's staff, board of directors, volunteers, and donors should promote 35 Hours of Giving over the course of the 35 hour event using social media.
  8. I agree for our organization to be listed on the 35 Hours of Giving website, and I understand that our organization name, logo, and photos may be used in promotional materials or activities.
  9. I understand that GiveGab.com is an online platform which will safely process all contributions made to the event.I understand that my organization will receive all the monies that have been donated to my organization less any transaction fees not covered by the individual donor.
  10. I understand that all donations will be disbursed within 3 business days via electronic funds transfer minus transaction fees, directly to my endowment fund at the Capital Region Community Foundation.
  11. I understand that the Community Foundation is providing tools and resources to aide me with this event, but that I am responsible for fundraising for my organization.
  12. I agree that all donations made during 35 Hours of Giving will become part of our Endowment Fund for purposes determined by the Fund agreement.
  13. I understand that only donations made during the 35 Hours of Giving event period will count toward any incentives or matching funds offered as part of the event.
  14. I understand that in the event of a disputed donation GiveGab will make every effort to win the dispute by submitting evidence on my organization's behalf. In the case that a dispute is lost, the full amount of the disputed donation and donation processing fees will be pulled from my organization’s bank account, and my organization will be charged a $15 dispute fee.
  15. I understand that refunds for donations made on GiveGab must be approved by an administrator from my organization and requested from GiveGab within 4 business days of the original date of the donation. If approved, the full amount of the requested refund and donation processing fees will be pulled from my organization’s balance. Any donation refund request made outside of the 4 business day refund window must be handled outside of the GiveGab platform between my organization and the donor directly.
  16. I understand that all donations during 35 Hours of Giving are made to the Capital Region Community Foundation for your endowment, meaning the information of all donors who participate in the event will be viewable by the foundation.
  17. I understand that 35 Hours of Giving is not responsible for the amount of money contributed to my organization over the course of the event and understand that donors choose where to place their gifts and that 35 Hours of Giving has no control of this decision.
  18. 35 Hours of Giving Prize winners chosen on the day of the event are subject to further verification and will be finalized 2 weeks after the event.
  19. I understand that an organization's participation in 35 Hours of Giving does not constitute an express or implied endorsement of a nonprofit or its mission by the Capital Region Community Foundation or any giving day partner or sponsor.
